Before I go, a quick reminder about some of the guidelines about what reports qualify for our news feed and police misconduct database:

1. We only track reports about misconduct committed by people who are employed as a certified or sworn officer at the time of the alleged incident. This means we don’t track misconduct committed by people who are no longer officers when they do something bad and we don’t track cases involving non-sworn employees like clerks, parking enforcement, or corrections officers.
2. We have guidelines set to limit updates on reports to only include status changes that are significant to a case that has already been tracked. So, while we would report that a cop who we tracked as being charged with a crime was convicted or sentenced for it, we won’t track that the officer’s trial started or specific items of testimony about the case were published unless that testimony revealed other allegations not already tracked.

Before I go, there was a second allegation of misconduct made against another NYPD officer dring today’s #OccupyWallStreet protest march. in this case, videos appear to show a police officer on a motorcycle run over the leg of a National Lawyer’s Guild observer then leave his bike parked on that man’s leg. He was eventually dragged away by police who arrested him and didn’t take him to the hospital until after booking him into jail. however, the reason this hasn’t been added to the database is that at least two independent photojournalists state that they saw him intentionally try to block the motorcycle with his leg before he was hit. t.co/cV9m0m30

The videos I’ve seen are inconclusive. while it seems like the officer approached at a high speed, the view of the actual incident is blocked. while it could be argued that the misconduct was the delay in treatment and subsequent denial of access ot the prisoner by lawyers requesting to see him after the arrest, the actual collision is too difficult to prove at this time due to conflicting third-party accounts.

Update: Someone at the DailyKos notes that it appears as though the observer was punched while being held down with a baton across his neck when he was dragged away from the bike in a video that appeared on the Keith Olbermann show. which might help explain the blood left on the pavement after the incident.
